Terms of Service

Welcome to Top Spin Tracker Pro (the “App”). These Terms of Service (“Terms”) form a legal agreement between you and the App’s publisher (“we,” “us,” or “our”). By downloading, installing, or using the App or this website, you agree to these Terms.

1) What the App Does

The App is designed to help players track and record ball spin revolutions per minute (RPM) when training with a TopSpinPro training aid using an iPhone. It provides training visuals, metrics, and history for personal use.

Note: TopSpinPro® is a third-party product and trademark of its respective owner. We are not affiliated with, endorsed by, or sponsored by TopSpinPro.

2) Eligibility & Safe Use

Use the App only if you can legally form a binding contract where you live. Always exercise safely: clear your surroundings and follow all instructions for your training aid and your device. The App is not a medical device and provides no medical, therapeutic, or injury-prevention advice.

3) Purchase, Pricing & Refunds
  • One-time purchase via the Apple App Store: US$24.99.
  • No in-app purchases.
  • Sales are final. Any refund requests are handled solely under Apple’s App Store policies.
  • Taxes may apply. Prices may change in the future for new purchases.
4) License

Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the App on Apple-branded devices you own or control, consistent with the Apple Media Services Terms and the Apple Licensed Application End User License Agreement (the “Apple EULA”). If there is any conflict between these Terms and the Apple EULA, the Apple EULA controls for App Store matters.

5) Acceptable Use
  • Don’t copy, modify, reverse engineer, decompile, or attempt to extract source code except to the extent allowed by law.
  • Don’t use the App to create a competing service or to violate laws, third-party rights, or safety rules.
  • Don’t interfere with or disrupt the App or our website.
6) Data & Storage

The App stores RPM measurements and related settings locally on your device. We do not transmit that data to our servers. You are responsible for backing up and managing your data on your device. Uninstalling the App may delete locally stored data.

7) Updates & Changes

We may provide updates that add, change, or remove features. The App may not function unless you install updates. We may modify these Terms—see the “Changes” section below.

8) Disclaimers

THE APP AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. Training results vary by user and conditions.

9) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP.

10) Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the App or any violation of these Terms.

11) Governing Terms

These Terms supplement the Apple EULA and applicable App Store policies. If any provision is unenforceable, the remaining provisions remain in effect.

12) Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, provide additional notice. Continued use after changes means you accept the updated Terms.
